These Terms of Service (hereinafter referred to as the "Terms") constitute a legal agreement between you (hereinafter referred to as the "User") and BTD Studio Co., Ltd. (hereinafter referred to as the "Provider") regarding your use of the smartphone application "American Mahjongg Classic" (hereinafter referred to as the "Service"). By accessing, downloading, or installing the Service, you are deemed to have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, no rights or permissions to use the Service shall be granted to you, and you must immediately cease all use of the Service.
If the User is under thirteen (13) years of age, or otherwise considered a minor under the applicable laws of their jurisdiction, they may only use the Service after a legal guardian (such as a parent) has thoroughly read, understood, and explicitly consented to these Terms. The Provider shall make the contents of these Terms publicly accessible within the application or on the official website at all times. The Provider reserves the right, at its sole discretion, to amend, modify, or update these Terms from time to time. Your continued use of the Service following any such changes constitutes your acceptance of the amended Terms.
Subject to the User's strict and continuous compliance with these Terms, the Provider grants the User a non-exclusive, non-transferable, personal, revocable, and limited license to access and use the Service solely for personal, non-commercial entertainment purposes. This license explicitly excludes any access to source codes, object files, or underlying algorithms.
The Service is free to download and play, but includes optional in-app purchases (pay-as-you-go) and a monthly subscription service to remove advertisements. While core gameplay features—including a limited selection of adaptive AI opponents, a basic tile set, the complete American rule mechanics (the 1st and 2nd Charleston phases, Courtesy Passes, player voting, and Joker exchanges), and the custom card editor—are provided free of charge, additional AI opponents and additional tile sets are available for purchase. Users can enhance their experience via real-money transactions. The User acknowledges and agrees that any data communication or internet connection fees incurred during the download, update, or use of the Service are the sole responsibility of the User.
The User is strictly prohibited from engaging in any of the following acts in connection with the use of the Service:
Notwithstanding any provisions to the contrary in these Terms, the User shall not be entitled to any permanent ownership, property rights, or proprietary interest in respect to their in-game account or profile. All rights, titles, and interests pertaining to the account shall remain strictly vested with the Provider.
The User shall not disclose to any third party any credentials required for logging into the Service. The User must not permit other individuals to utilize their account, nor log into a single account simultaneously with other users. The Provider shall bear no liability for any disputes, data losses, or damages caused by the leakage or unauthorized use of account information. The User is fully responsible for all activities occurring under their account.
The Provider may, at its arbitrary discretion and without prior notice or statement of reason, suspend, terminate, or permanently delete the User's account in the event of a breach of these Terms, prolonged inactivity, or administrative necessity. Upon account deletion, all accumulated game data, unlocked tile sets, custom card patterns, and statistics will be immediately destroyed without any possibility of restoration or compensation.
The Service features a "Custom Card Editor" that allows Users to design, customize, and save their own proprietary Mahjongg pattern cards (including tile counts, suit colors, and point allocations). Any content created, uploaded, or transmitted by the User via this feature shall be defined as "User Generated Content" (UGC).
The User represents and warrants that their UGC does not infringe upon any third-party intellectual property rights, copyrights, privacy rights, or public order. The User shall be solely liable for any legal claims arising from their creations.
The User hereby grants the Provider a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, display, and distribute their UGC within the framework of the Service. Furthermore, the User expressly agrees to waive all moral rights (including the right to integrity, the right of attribution, and the right of publication) in or to any contents transmitted or created while using the Service. The Provider reserves the right to monitor, review, filter, hide, or permanently delete any UGC at any time if it is deemed inappropriate, offensive, or in violation of these Terms, without prior notification or liability.
The Service may contain virtual commodities, collectibles, tokens, or progression points (hereinafter collectively referred to as "Virtual Goods") representing in-game elements. Regardless of whether these Virtual Goods are earned through gameplay achievements or unlocked via event participation, the User acknowledges that they possess no inherent monetary value, real-world property rights, or legal title to such elements. Virtual Goods are licensed to the User as a highly limited, revocable, personal right of use within the application. They cannot be sold, traded, transferred, or exchanged for real-world fiat currency, goods, or services outside of the application.
The Provider is entitled to modify, update, enhance, restrict, or suspend in part, or terminate in whole, the Service at any time, for any reason, without obligation to provide advance notice or public announcements regarding product changes. Upon the temporary or permanent termination of the Service, all licenses granted to the User under these Terms shall expire with immediate effect. The Provider bears no responsibility or liability for compensating or refunding the loss of game data or unlocked Virtual Goods resulting from such termination.
THE SERVICE IS PROVIDED ENTIRELY ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND IS SUBJECT TO CHANGE WITHOUT NOTICE. THE PROVIDER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, AND EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UNINTERRUPTED AVAILABILITY, ERROR-FREE OPERATION, SYSTEM STABILITY, LEGAL COMPATIBILITY, OR THE TOTAL ABSENCE OF VIRUS INFECTION OR MALWARE.
THE USER ACKNOWLEDGES THAT THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SERVICE REMAINS WITH THE USER. IN THE EVENT THAT A TECHNICAL MALFUNCTION OCCURS, OR IF THE USER IS DISSATISFIED WITH THE SERVICE, THE USER'S SOLE AND EXCLUSIVE REMEDY IS TO CEASE ALL USE OF THE SERVICE AND UNINSTALL THE APPLICATION. THE PROVIDER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT.
These Terms constitute the complete and exclusive agreement between the User and the Provider regarding the utilization of the Service, and completely supersede all prior or contemporaneous oral or written agreements, understandings, communications, or memorandums.
If any provision or portion of these Terms is determined to be void, invalid, illegal, or unenforceable by the laws, regulations, or competent courts of an applicable region, such determination shall not affect the validity of the remaining provisions. The unenforceable portion shall be construed and modified in a manner that best reflects the Provider's original economic and legal intentions while remaining valid under local law, and all other clauses shall continue in full force and effect.
The Provider may transfer, assign, or delegate all or part of its rights, titles, duties, and obligations under these Terms and the Privacy Policy to a third party (such as a successor entity or corporate buyer) at any time, with or without the consent of the User. The User may not transfer, assign, sub-license, or delegate any rights or obligations granted to them under these Terms without the express, prior written consent of the Provider. Any unauthorized attempt to transfer or assign such rights shall be deemed null and void.
These Terms, their interpretation, construction, and any legal disputes or claims arising out of or in connection with the Service shall be governed by, and construed exclusively in accordance with, the laws of Japan, without regard to conflict of law principles.
The User and the Provider expressly agree that the Tokyo District Court located in Tokyo, Japan, shall have exclusive first-instance jurisdiction to address, adjudicate, and resolve any disputes, claims, or lawsuits arising between the parties in connection with the Service.
